Privacy Statement

Last updated: August 1, 2026

Rasta Sense LLC (“us”, “our”, “we”, and the “Company”) respects your (“you” and “your”) privacy and is committed to protecting it through our compliance with this Privacy Statement (the “Statement”). This Statement explains how we collect, use, process, retain, disclose, and safeguard your data when you use the RASTA Gunshot Detection device (the “Device”), applications (“Apps”), and related cloud services (collectively, the “System”) or our website (our “Website”). This Statement also describes our practices for using, maintaining, protecting, and disclosing that information.

We may provide additional or different privacy notices, statements, product-specific notices, or policies that are specific to certain features, services, or activities of the Company, which will apply in addition to this Statement.

Please read this Statement carefully to understand our policies and practices regarding your information and how we treat it related to the System and our Website. By interacting with our System, our Website, or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Statement.

Pursuant to Section 12 below, this Statement may change from time to time. Your continued use of the System or our Website after we make changes as described in this Statement is deemed to be acceptance of those changes, so please check this Statement periodically for updates.

1.  Audio and Certain other Data Processing and Transmission on Servers through the System

The Device “listens” to sounds in the installed environment, continuously reading one (1) second of sound into the Device’s temporary memory (RAM) stored locally on the Device (the “Locally Processed Sound Data”). The Locally Processed Sound Data is not transmitted to any remote server or processed remotely, and the Company cannot hear or access the Locally Processed Sound Data.

The Device uses artificial intelligence operating within the Device itself, not remotely, to interpret and classify Locally Processed Sound Data as either including an acoustic event that is likely to be a potential gunshot (a “Detected Event”) or not including a Detected Event. If the Device does not detect a Detected Event, the Locally Processed Sound Data is deleted and the Device takes no further action. No sound data is stored in permanent memory on the Device at any time.

If the Device detects a Detected Event, the Device records a few seconds of sound data (“Recorded Sound Data”) and, assuming all Dependencies are met, transmits Recorded Sound Data to an external server and to authorized users’ via the Apps. The Apps allow authorized users to enable or disable features allowing transmission of Recorded Sound Data. The Company has access to Recorded Sound Data and may use it for purposes of improving and retraining its artificial intelligence model.

We further collect and store data through our System such as device specifications, device configuration, performance statistics, our event-related analysis and post-incident review, emergency incident reporting, and the location of your device.

By using the System, you authorize monitoring of the acoustic environment and consent to audio recording on behalf of all persons in that environment, and represent and warrant that you have authority to do so. You are responsible for obtaining required consent and providing notice to third parties relating to recording or sharing through the System. You may not use the System in a jurisdiction that prohibits the monitoring of the acoustic environment or recording of audio in the manner described above. You are solely responsible for compliance with applicable law, including all recording, sharing, eavesdropping, and privacy laws, whether in private or public spaces (as applicable), as well as individual rights. We are not responsible for violation of any law or right.

The System collects and transmits data, including Recorded Sound Data, Device geolocation data, and event data from the installed environment through the App. By using the System, you consent to our collection and use of data in accordance with this Statement, including geolocation data, on behalf of all persons in the installation environment, and represent and warrant that you have authority to do so. We are not responsible for violations of privacy or other laws or rights as a result of your use of the System or failure to obtain any required consents.

Audio capturing, transmission, and storage are disabled when the device is not plugged in, depleted of power, or turned off. If the device is disabled, depleted of power, or “off,” the System cannot record any audio data or detect potential gunshot events.

For more information about the System, its intended use, and its limitations, please see our Terms of Service , to which this Statement is incorporated therein.

6. Enhancing System Performance

In particular, the System utilizes machine learning technology to detect potential gunfire events  and to improve the System’s ability to detect potential gunfire. Recorded Sound Data collected from your Device helps the System and its corresponding device better identify and notify users of potential gunshot events, and is used to train our machine learning models. By learning from real-world interactions, the Company can adapt the System to different acoustic environments and provide more accurate detection.

Our training process may include both artificially intelligent machine learning and supervised machine learning, which is an industry-standard approach where a very limited sample of your audio data including only Recorded Sound Data is reviewed by humans to help the System interpret potential gunshot events and deliver the correct response.

The Company is committed to utilizing your collected personal data responsibly to enhance the performance and reliability of its System. By leveraging advanced machine learning, both automated and human-supervised, we may ensure continuous improvement in gunshot detection accuracy while maintaining strict privacy standards and limiting data retention to a defined period. These practices enable the Company to provide a safer and more responsive service for all users – including you.

Please see Section 7 of our Terms of Service , to which this Statement is incorporated therein, for more information regarding how the Company utilizes artificial intelligence within the System and its related software.

7. Data Retention

The Company may retain and use personal data collected through the System or our Website for up to two (2) years to develop and improve the System, our Website, and any other Company products or services. However, the Company may retain Recorded Sound Data indefinitely. At the end of the retention period, personal data will be deleted, destroyed, or deidentified. However, please note that in certain situations, we may be legally permitted or required to keep such data beyond this disclosed retention period.

8. Data Sharing

THE COMPANY DOES NOT SELL, RENT, OR SHARE YOUR PERSONAL INFORMATION FOR ADVERTISING OR MARKETING PURPOSES.

Your personal data is strictly used to enable, operate, and support the System and our Website. We may disclose personal data that we collect or you provide as described in this Statement:

  • To our subsidiaries and affiliates;
  • To contractors, service providers, and other third parties we use to support the Company and who are bound by contractual obligations to keep personal data confidential and use it only for the purposes for which we disclose it to them;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by the Company is among the assets transferred;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our Terms of Service and other components of the Agreement, including for billing and collection purposes;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others, such as your account and contact information and payment information for the purposes of fraud protection and credit risk reduction;
  • To fulfill the purpose for which you provide it;
  • For any other purpose disclosed by us when you provide the information; or
  • With your consent.

 Additionally, in the event that a potential gunshot is detected, the Company will share relevant data – including, but not limited to, device location, the time of the event, and associated Recorded Sound Data – with authorized users, which may include law enforcement agencies and emergency services. This data sharing is conducted solely for the purpose of enabling a timely and effective emergency response and ensuring public safety.

For all purposes, the Company employs secure transmission methods and restricts access to authorized personnel to protect your privacy when sharing personal information with any parties as described above. No personal information collected from the System or our Website is shared beyond what is necessary to facilitate System and Website operation.

We may also disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We implement industry-standard security practices including encryption, secure communication protocols, and access controls to protect your information from unauthorized access, alteration, disclosure, or misuse. However, no website, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the System or our Website. In particular, email, texts, chats, and other messages sent to or from our Website may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal data is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, modification, and access.

10. Third-Party Services and Features

The System and our Website may allow you access to third party services and features that operate independently from us. The privacy practices of the relevant third parties, including details on the information they may collect about you, is subject to the privacy statements of these parties, which we strongly suggest you review. To the extent any linked online services or third-party features are not owned or controlled by us, the Company is not responsible for these third parties’ information practices.

FOR THE AVOIDANCE OF DOUBT, THIS STATEMENT DOES NOT APPLY TO INFORMATION COLLECTED VIA ANY THIRD PARTY, INCLUDING THROUGH ANY APPLICATION, ADVERTISEMENT, OR OTHER CONTENT THAT MAY LINK TO OR BE ACCESSIBLE FROM OR THROUGH THE SYSTEM OR VIA OUR WEBSITE.
